FIREWORKS! Are they legal?

Some of our residents have noticed the ‘FIREWORKS FOR SALE HERE’ signs at some local businesses around our town and county and are asking us “is it legal for businesses to be selling fireworks in NYS?”. Well, the signs are false advertisement.

The State of New York passed a law stating “New York State Law allows for the sale and use of a specific category of consumer fireworks known as Sparkling Devices.

Sparkling Devices are ground based or handheld devices that produce a shower of colored sparks and or a colored flame, audible crackling or whistling noise and smoke. The law limits the type, size and construction of Sparkling Devices and requires that these devices must be hand held or mounted on a base or spike and be limited in sizes that range from 1 to 500 grams of pyrotechnic composition.”

The selling of traditional FIREWORKS are still illegal in NYS but the selling of SPARKLING DEVICES is now legal. Even thought these sparkling devises don’t make the ‘big boom in the sky’, they are still dangerous and may cause injury or fire to surrounding areas or structures so PLEASE USE CAUTION.
